6. Intellectual property
Unless otherwise stated, the website and its content—including sculptures, photographs, films, illustrations, designs, text, recordings, logos and page layouts—are owned by or licensed to The Global Gallery Ltd.
All rights are reserved.
You may:
-
view the website;
-
temporarily store pages through normal browser operation; and
-
share links to publicly accessible pages.
You may not, without prior written permission:
-
reproduce, sell or commercially exploit website content;
-
create merchandise or derivative artwork from it;
-
remove copyright, attribution or ownership notices;
-
use photographs or artwork in advertising or promotional material;

-
suggest that Donald Brown, The Global Gallery or another person endorses you, your organisation or your product.
Media organisations may use material specifically supplied through an approved press pack, subject to the conditions accompanying that material.
7. Photographs and public figures
The website may contain historical photographs showing Donald Brown with artists, public officials, athletes, entertainers and other notable individuals.
Their appearance records a meeting, presentation, event or relevant historical context. It does not, by itself, mean that the individual endorses The Global Gallery, Donald Brown, a product, a sponsorship opportunity or a campaign.
You must not reproduce or use these photographs in a way that falsely suggests endorsement, affiliation or approval.
8. Information and materials you submit
If you submit text, photographs, video, testimonials, nomination material or other content, you confirm that:
-
the information is accurate to the best of your knowledge;
-
you are entitled to submit it;
-
its use will not infringe another person’s rights;
-
it is not unlawful, defamatory, discriminatory, threatening or misleading;
-
it does not contain unnecessary confidential or sensitive information; and
-
you have obtained any permissions reasonably required from identifiable people.
You retain ownership of your material.
You grant The Global Gallery Ltd a non-exclusive, royalty-free licence to store, review, reproduce and use the material as reasonably necessary to:
-
administer your request or nomination;
-
verify eligibility or authenticity;
-
communicate with relevant participants;
-
operate and promote the relevant programme; and
-
comply with legal, safeguarding and record-keeping requirements.
We will obtain additional permission where wider public or commercial use requires it.
We may remove, reject or decline to publish submitted material where we reasonably believe it breaches these terms or creates a legal, ethical, safeguarding or reputational risk.
9. Nominations
City, community and other nomination programmes may be subject to separate published rules.
Unless those rules expressly say otherwise:
-
submitting a nomination is free;
-
one person must not manipulate the process through automated or duplicate submissions;
-
nomination totals may be checked, adjusted or rejected to protect the programme’s integrity;
-
we may request evidence or identity verification;
-
nominations may be moderated;
-
a nomination is not a binding vote or contractual offer;
-
the highest number of submissions does not automatically guarantee selection;
-
eligibility, feasibility, funding, permissions, safeguarding and local participation may all be considered;
-
receiving a nomination does not guarantee that a sculpture will be produced or installed; and
-
we may pause, amend or cancel a nomination cycle where reasonably necessary.
Any public description of a selection process will identify the applicable criteria and decision-making arrangements.
10. Speaking, sponsorship and commission enquiries
Submitting an enquiry does not create a booking, sponsorship, commission, partnership, agency relationship or other binding agreement.
No arrangement is confirmed until:
-
the scope and deliverables have been agreed;
-
availability and feasibility have been confirmed;
-
any required due diligence has been completed;
-
fees, expenses and payment terms have been agreed; and
-
an authorised representative has accepted the arrangement in writing.
Sculpture commissions, sponsorships and major projects will normally require a separate written agreement.
11. Purchases
Purchases of artwork, prints and other products are governed by the Terms of Sale and Returns Policy presented before checkout.
Product images and descriptions are intended to be accurate. However:
-
colours may vary between screens and printed or physical products;
-
dimensions may be approximate;
-
natural, handmade or limited-edition items may have minor variations; and
-
availability may change.
Nothing in these Terms of Use limits your statutory rights as a consumer.
12. Third-party websites and events
The website may link to:
-
conference organisers;
-
YouTube and other media platforms;
-
payment providers;
-
delivery providers;
-
social networks;
-
sponsors; and
-
other independent organisations.
We do not control those services and are not responsible for their content, availability, security or terms.
A link does not necessarily constitute endorsement. You should review the third party’s terms and privacy information before using its service.
Information about an independently organised conference or event may change. Confirm dates, venues, admission requirements and programmes with the official organiser before making travel or financial commitments.
13. Website availability and security
We aim to keep the website accurate, secure and accessible, but we do not guarantee uninterrupted or error-free operation.
We may temporarily restrict access for maintenance, security, updates or circumstances outside our reasonable control.
You are responsible for maintaining suitable security, software and backups on the device used to access the website.
14. Accuracy of information
We take reasonable care when preparing website content. However, historical claims, event details, campaign projections, availability, prices and third-party information may change.
Forward-looking statements—including anticipated audience reach, sponsorship exposure, campaign duration or participation—are objectives or estimates unless expressly described as independently verified guarantees.
You should contact us before relying on website information for a significant commercial decision.
15. Our responsibility to you
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation; or
-
breach of rights that cannot legally be excluded.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable or that result from circumstances outside our reasonable control.
If you use the website for business purposes, we will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, loss of anticipated savings or loss of goodwill arising solely from use of the informational website, except where liability cannot lawfully be limited.
These Terms of Use do not replace the liability provisions in a specific sales, sponsorship, booking or commission agreement.
16. Suspension and termination
We may block or suspend access to the website, reject a submission or remove content where we reasonably believe that:
-
these terms have been breached;
-
the website or another user is at risk;
-
a submission is fraudulent, abusive or unlawful;
-
legal or regulatory action requires it; or
-
suspension is otherwise reasonably necessary to protect the programme or business.
17. Privacy and cookies
Our collection and use of personal information is explained in our Privacy Policy.
Our use of cookies and similar technologies is explained through our Cookie Policy and Cookie Settings.
18. No waiver
If we do not immediately enforce a provision of these terms, that does not mean we have waived our right to enforce it later.
19. Severability
If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
20. Transfer of rights
We may transfer our rights and obligations under these terms as part of a genuine business reorganisation or transfer, provided that doing so does not reduce a consumer’s legal protections.
You may only transfer your rights or obligations with our written agreement, except where applicable law provides otherwise.
21. Governing law and jurisdiction
These terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections available under the law of your home jurisdiction and may be entitled to bring proceedings in your local courts.
Business users agree that the courts of England and Wales will have exclusive jurisdiction, unless a separate written agreement states otherwise.
